Objection to Disclosure of Student Information – April 1, 2016
In 2012, a group of parents filed a lawsuit against the California Department of Education (CDE) claiming, in part, that the CDE failed to appropriately oversee local school districts and their compliance with special education and Section 504. As part of that lawsuit, the CDE has been ordered to provide to the court documents that include personally identifiable information of certain students: 1) students (including infants) with disabilities 2) children who requested an assessment or who were assessed for special education eligibility and 3) students who are attending or attended a California school at any time since January 1, 2008.
However, parents or guardians of such students is able to object to the disclosure of the student’s information by submitting an objection to the Court. Parents can find more information regarding this lawsuit, how to object to the disclosure of their student’s information, and a sample Objection Form at the following website. Please note that the deadline to submit an objection to the Court is April 1, 2016. “
